Chapter 99
Papa Devon and his cousin's younger brother who was none other than Samsul just fell silent to see the debate full of drama at dawn that day.
Finally Ustad Samsul has a pretty powerful idea in overcoming all these misunderstandings.
"Son Mika can Al be with his nanny first?" ask ustad Samsul.
Mika fell silent while hugging her crying child, after a while Mika responded to Samsul's questions with a nod of her head and called babysister kaka Al to immediately hold Kaka Al.
Papa Devon saw the remaining four of them staying in front of the room asking to talk about this matter in his study.
As usual they obey the request of the big master of this house.
After being in the room, Papa Devon asked all to sit down and then ustad Samsul who continued his conversation in the middle of the problems that occur in domestic life between Devon and Mika.
Ustad Samsul gave Mika the first opportunity to explain the problems that occurred and what Mika wanted.
Mika explained that she had a dream that Devon and the female actor were taking Al away.
The three of them between Devon, his papa and Samsul's ustad look at each other after hearing Mika's explanation of her dream.
Devon, who is a suspect in the dream, reluctantly explains to straighten out Mika's misunderstanding.
"Love please listen to me, I swear I never had any intention in my mind to take our child with that woman, indeed I am guilty and have hurt you many times, he said, as long as you know dear that in my heart and my hope is the wholeness of our family, there is nothing else and do not want anything else" said Devon.
Devon who said it with real no intention to lie to his wife.
"Son Mika is Devon's explanation enough?" ask ustad Samsul.
"What about your current relationship?" ask Mika next.
"I ended my relationship 4 months ago and there's never going to be another relationship, I promise you" Devon said.
Mika who heard Devon's explanation hesitated a little, but Mika tried to see if there were any more lies that her husband covered.
Mika continues to search for her husband's lies but Mika is unable to find him.
After that, Ustad Samsul reaffirmed what Mika's next hope in this marriage.
Mika again answered what she wanted in the household.
"I want my husband to be a good priest for myself and my children, besides Mika hopes that there will be no more love in her marriage relationship" Mika asked.
"Surely it is, dear, in front of my father and mother I promise to strive to be a good priest for our family, besides I promise there will never be any more lies in our household" devon's promise to his wife.
Papa was moved by his son's attitude to win his wife's heart.
Mika chose to seek the truth with proof rather than promise.
"Show with your attitude is not just a promise that is easily denied that the end is just a joke" said Mika.
"It must be a pity" replied Devon, he was deeply moved by his wife's wishes.
Papa Devon hurt that too until speechless.
After finishing in interrogating Mika now gilirian Devon. Ustad Samsul asked the same question when asked Mika, which is to rethink whether the next hope in their marriage.
"I beg you please give me a chance to improve our domestic relations" Devon said.
Mika was just speechless hearing her husband's wish request.
"How do you want Mika, do you want to take your husband back?" ask ustad Samsul.
"I want to see evidence not promises" Mika said loudly.
After that ustad samsul asked back what Devon hopes in his marriage.
"I asked to be given a chance in our household and be able to start a new chapter in our marriage" Devon said.
Not only were Samsul and Devon's father shocked by Mika's answer, but Devon as well. Really do not know what else to say in solving this household crisis.
Now you both know how you feel each of you is in your heart and what your hopes are in this household.
Because you have been separated for more than 4 months and Devon is indifferent in giving birth and bath and there is a parting word spoken by Devon, then it is better we do the marriage contract back according to Islamic law.
After that Ustad Samsul reminded back sighat ta’liq in marriage so that in the future Devon did not easily leave Mika just for the sake of sheer satisfaction.
Ustad Samsul also explains the Quranic verse that governs the passing of a husband to his wife.
First, if a husband leaves his wife on the grounds of an interest such as making a living, then this is okay.
Allah says in the letter of At-Talaq Verse 6
"Put them (wives) where you live according to your ability and do not trouble them to constrict (heart) them. And if they (the wives who have been treated) are pregnant, then give them their bread until they give birth, then if they suckle your (children) for you then give them the reward, and deliberate among you (everything) well; and if you find trouble then another woman may suckle (the child) for her".
Al-Buhuti explained,
"When the husband goes on safar leaving his wife because of udzur or deed, then the right of marriage and relationship to the wife fall. Although the safar was long, because udzur. (Kasyaf al-Qana’, 5/192)."
"The wife should be patient with the husband because the husband leaves her to work. Especially if the husband always gives news and still gives a living born so that all the needs of the wife and children remain fulfilled".
But it is different if the second condition that occurs, namely if the husband leaves the wife without udzur or interests. In marriage in Indonesia, there is sighat ta’liq which is read and signed by the husband. If the husband signs and reads this sighat, then the wife has the right to file for divorce after being left for 3 months
To my wife I expressed sighat ta’lik as follows :
When I :
Leaving my wife for 2 (two) consecutive years;
Not to give him a mandatory living for 3 (three) months;
Hurt my wife's body or body;
Let (do not care) my wife for 6 (six) months or more,
And because of my actions, my wife did not want to and filed a lawsuit with the Religious Court, then if the lawsuit was accepted by the Court then my wife paid Rp. 10,000, then she said,- (ten thousand rupiahs) as ‘iwadl (substitute) to me, then my talaq fell one to him. To the Religious Court I gave the power to receive the money ‘iwadl (substitute) and handed it to the local National Amil Zakat Agency for social worship purposes.
Samsul explained to Devon that
Allah says,
"Do not defend them against harm, for you are persecuting them."(QS al - Baqara: 231).
So for women who cannot wait for the husband who does not provide clarity is allowed to apply khulu’.
"Do you two now understand your duties and responsibilities as husband and wife?" ask ustad Samsul.
"Yes mang" replied Devon and Mika.
After that they disbanded from Devon's courtroom and prepared a re-marriage agreement for Devon and Mika.
