Assalamualaikum my brother and sister. How are you today. May we all be in the protection of Allah SWT. Amyn..
Well guys. Having my clarification here, I want to share knowledge for us to both learn about "The Law of marrying a pregnant woman" . Well, a lot of us are misguided, so I'm here to share a little knowledge that I know.
Marrying a pregnant woman for adultery "adultery" is not because of the pregnant woman divorced by her husband, so it is clear the law is to wait until the woman gives birth.
These are some reviews of some of the opinions of our great scholars.
First the opinion of Imam Abu Hanifah who explained that if the one who married the pregnant woman was the man who impregnated her, the law may be. Whereas if the man who married her was not the man who impregnated her, then the man should not marry her until giving birth.
Both Imam Malik and Imam Ahmad bin Hanbal said that men who do not impregnate should not marry women who are pregnant, except after the pregnant woman gave birth and has expired 'iddation.
Imam Ahmad added one more condition, that the woman must have repented of her sin. If he has not repented of the sin of adultery, then he still cannot marry anyone. It is mentioned in Al-Majmu's Sharah Al-Muhazzab by Al-Imam An-Nawawi, Jus XVI page 253.
The third opinion of Imam Asy-Shafi'i which explains that both men who are impregnating or who are not impregnating, are allowed to marry him. As stated in the book of Al-Muhazzab by Abu Ishaq Asy-Syairazi juz II page 43.
..
As for the opinion that forbids a man to marry a woman who is pregnant with children from others. Because it will cause confusion of the child.
In the following words, the Prophet SAW said: "Do not be fucked (married) a pregnant woman (for adultery) to give birth." (HR Abu Daud and set aside by Al-Hakim). Also in another account, the Prophet SAW said: "It is not lawful for a Muslim who believes in Allah and the last day to pour his water on the crops of others." (HR Abu Daud and Tirmizy).
..
Regardless of the illegal or not.
The story we take from Vishnu who married Mora is to save him from the great sin of suicide. Because we know, Mora threatened to kill himself if not married.
And I personally take from the income of the Shafi'i priest who says if marrying a pregnant woman belongs to another man the law is lawful. However, it cannot pay her until the woman gives birth.
..
I am a Muslim friend who I respect. This is the science that I have learned and I share with you hopefully useful.
Regardless of whether it is legitimate or not.
Muslims are our duty to lead people on the right path. Do not punish our brothers who have done wrong/sin. Lead them and lead them, lead them to repent on the right path.
Sorry if there are some words and opinions that are not pleasing to the readers.
We both learned, hopefully useful... Assalamualaik... 🙏🙏
