Article 27 paragraph (3) of the ITE Law

"Every person intentionally and without the right to distribute and/or transmit and/or make accessible electronic information and/or electronic documents that are charged with insult and/or defamation"

Article 310 paragraph (1) of the Criminal Code

Anyone who deliberately attacks the honor or good name of a person by accusing something, which means light so that it is known to the public, threatened for pollution with a maximum prison sentence of nine months or a maximum fine of four thousand five hundred rupiah.

For instance, a person who is proven to deliberately disseminate defamatory electronic information as intended in Article 27 paragraph (3) of the ITE Law will be charged with Article 45 Paragraph (1) of the ITE Law, maximum prison sentence of 6 years and/or a maximum fine of 1 billion rupiah.

Article 45 of the ITE Law

(1) Any Person who fulfills the elements as referred to in Article 27 paragraph (1), paragraph (2), paragraph (3), or, or paragraph (4) is punished with a maximum prison sentence of 6 (six) years and/or a maximum fine of Rp1,000,000,000.00 (one billion rupiah).

There are still other articles in the ITE Law that are related to defamation and have criminal sanctions and heavier fines, pay attention to article 36 of the ITE Law.
