93. Menstruated

First, Imam Ibn Abbas and Abidah Al-Salmani said, a husband should stay away from all the limbs of his wife during menstruation. That is, it should not concern his wife in any way because it is based on the generality of the verse. Second, the majority of scholars such as Imam Malik, Imam Shafi’i, Imam Auza’i and Imam Abu Hanifah confirmed that the limb of the wife that should be shunned is the limb between the knee and navel," explained Ega.

"Connecting during menstruation is a serious violation. This practice is agreed by the scholars regarding its fragrance based on Surat Al-Baqarah verse 222. The legal status of the practice related to menstruation also applies to the practice of jamak when the wife is undergoing puerperium.

Body relations when the wife is undergoing the puerperium is also a serious offense as the following statement: “Connect with the wife who is menstruating illegally based on the agreement of scholars. A Muslim who considers it halal can turn into a kufur. This holiness is based on the word of God, ‘They ask you about menstruation, say, ‘It is dirt. Therefore, stay away from women during menstruation. Do not approach them until they are holy. If they are holy, then come from the way that Allah has commanded you. Indeed, Allah loves the repentant and the holy,’’ (Sura Al-Baqarah verse 222)," explained Ega.

This sanction designation refers to the following hadith of Abu Dawud and Al-Hakim: “A husband who has sex with his wife during menstruation is recommended to give alms to one dinar if the relationship is done when menstrual blood has just come out (still heavy), he said, and half the dinar when menstrual blood begins to recede based on the hadiths of Abu Dawud and Al-Hakim. He (Al-Hakim) judged this shahih hadith. The Prophet said, ‘If a person is in contact with his wife when he menstruates, he should give one dinar if his menstrual blood is still red and half dinar when his menstrual blood has turned yellow." In addition to being sanctioned for grave violations, one is also required to repent to God because this practice is a great sin to be shunned" said Ega.
