Meaning of Catholic MarriageThe meaning of catholic marriage according to KHK1983 can.1055 §1 is a covenant (phoedus) between a man and a woman to form a life togetherness. The background of this definition is the document of Vatican Council II, Gaudium et Spes §48). GS and KHK no longer define marriage as a contract.
Destination of marriage
Marriage has three purposes: the welfare of the husband and wife, the birth of children, and the education of children. The main purpose of this is no longer the procreation or birth of a child. This affects the possibility of child birth restriction (KB).
The nature of Catholic marriage.
The Catholic marriage is essentially one forever and indissolubility. We call it Monogamous and Indissolubile. Monogam means one man with one woman, while indissolubile means, after the marriage between the baptized (ratum) legally and consummated by intercourse, the marriage becomes indissolubile, the marriage becomes indissolubile, except by death. This can be found in the Church Law of 1983 (right. 1141).
What is meant by Catholic marriage is a marriage that follows the procedure of the Catholic Church. Such marriages are generally held between those baptized in the Catholic Church (both Catholic), but may occur between those who are baptized in other non-Catholic Churches.
A marriage between baptized persons is called a ratum (c. 1061) whereas a marriage between a non-Catholic person is called a non-ratum marriage. A ratum marriage, having been consummated by intercourse (consummatum) becomes a ratum et consummatum marriage which cannot be decided or annulled by any power, except death (c. 1141). A marriage that is ratum et non consummatum can be decided by the Holy See by the request of one of the spouses (right. 1142)
Marriage agreement
Marriage agreement or agreement (foedus) made by both parties married is the only determining element that “makes “marriage itself. This agreement must arise from the couple's own wife, not from someone else.
This agreement presupposes the freedom of each party to uphold their marriage. This means that each party must be 1free from outside coercion, 2 unhindered from marriage, and 3 legally able. This agreement must be declared publicly and lawfully according to legal norms.
The Church forbids conditional marriage. Every conditional marriage always fails the marriage. The Church follows the theory of Pope Alexander III (1159-1182) that sacrament marriage began to exist or exist since the marriage agreement . But the marriage of the sacrament is not completely divorced after it has been consummated with the union, since it then presents the perfect and complete union of love between Christ and His Church. The object of marriage agreement is the togetherness of the whole life (consortium totius vitae which is directed at the 3 purposes of marriage above.
Legal structuring
Every Catholic marriage, even if only one is Catholic, is governed by these three laws, namely 1 divine law, 2 canon law, and 3 civil law as far as civil consequences are concerned. A divine law is a law that is understood or arrested on the basis of revelation, on the basis of human common sense as coming from God Himself.
For example, the nature of monogamy, indissolubile, marriage agreement as a marriage maker, and barriers to marriage. This law is binding on everyone, without exception (including non-catholics). Canon law or Church law is a written norm established and ratified by the Church, ecclesiastical and thus binding only to baptized Catholics (c. 11). While civil law is a law that deals with civil effects that apply in the area of ybs., for example in Indonesia, there are things set by the government, such as the age of candidates, civil registration, etc.
Because marriage is concerned with both parties together, non-Catholics who marry Catholics are always bound by the law of the Church. The Church has the power to regulate the marriages of its citizens, even if only one of the couples is Catholic. That is, their marriage is only valid if it is carried out in accordance with the norms of canon law (and certainly divine).
Because it is ecclesiastical, the state does not have any right to declare legal/at least Catholic marriage or matters between married couples. The Civil Registry Office in Indonesia has the task of only recording marriages that have been inaugurated by religion, and is not in charge of carrying out marriages, in the sense of confirming a marriage.
Canonical investigation
Pre-marital investigations are, in practice, referred to as canonical investigations. This investigation is so that the priest or pastor of the people has moral certainty that the marriage to be carried out later is valid (valid) and feasible (sneaky) because he believes that there are no obstacles that can be canceled and not there are prohibitions that make marriage unfit. This certainty must be possessed in order to maintain the sanctity of marriage.
The matters investigated are the free status of candidates, the absence of obstacles and prohibitions, and the candidate's understanding of Christian marriage.
