"Sorry, Gus. I'm going to the shop for a minute. My cigarette is gone." Said Sobri will call Ajimukti after the Dzuhur.
Ajimukti just nodded, then walked ahead of Sobri in follow Manan. Sobri soon passed and rushed to the stall where he used to buy cigarettes.
"Obsolutely yes, Kang." Say Sobri to the seller while giving money.
"Wrap it, Kang?" Ask the seller then.
"Yes, Kang. Bring that money." Sobri Sahut.
"Bring it up is okay, Kang. I'm like anybody." The seller was half-joking.
"Ah, that was it, Kang." Sobri again.
The seller no longer denied it only then handed a packet of kretek cigarettes to Sobri.
"Chess of nuwun, Kang." Sobri said after that.
"Sami sami, Kang." Reply to the seller.
Sobri immediately opened the pack of cigarettes and took it for light. But at that moment he forgot to bring a match. Coincidentally not far from him, sat a middle-aged man smoking a cigarette.
"Ngapunten, sir. Any light matches?" Sobri said borrowed a match.
"Oh, yes, Mas." Said the man while reaching for a match in his pants pocket and then thrusting it at Sobri.
"Suwun, sir." Sobri said after he finished lighting a cigarette.
"Yes, Mum." The man smiled with a pias at him.
Before long the man was seen receiving a call through his cell phone. Sobri could hear the man's conversation.
"But, Deck. If not credit, where can I pay cash." The man complained with a heavy tone.
Sobri did not mean to eavesdrop, only that the voice of the man next to him was loud enough to arrive at his hearing senses.
Before long the man seemed to turn off his phone and then let out a deep sigh. Sobri slightly glanced at the man then frowned.
"Is there a problem, sir?" Ask Sobri later.
The man immediately turned his head to look at Sobri and smiled.
"Regular, Mom. There's a difference of opinion with the wife." The man was still in the same position of view.
Sobri just nodded his head nod although he did not know what the problem was.
"Dizziness if it's like this." The man's complaint arrived. From his voice, there was a burden on the man's pelvis next to Sobri.
"What's wrong, sir? Sorry, it's not my intention to interfere in your personal affairs. If it's personal, it's best not to tell, sir." Sobri later said.
The man again took a deep breath.
"My wife wants a bike but cash, Mas. While my income is pasan. I can, but credit. But my wife refused on illicit grounds because the credit arrived he said." Said the man in the end.
Sobri nods his head to hear the man's story. Now he knows what problems the man next to him is facing.
"But isn't all that credit illegal, sir?" Sobri later said.
"Come, Mas. I don't really understand the law like that. That's why I'm confused, too, my mother." The man then.
"Indeed, Sir. This credit problem is growing in the community because there are some people who think that this credit is usury. In general, credit is permissible in Islam and the law is not illegal. This is based on the commitment made by both parties in the transaction. By following the rules and regulations that apply sharia, sir. That's from what I know, sir." Sobri later said.
"This is what santri in the pesantren is there?" Asked the man while pointing his hand towards the Hidayah boarding school.
Sobri only then nodded her head.
"What a coincidence then, Mom. Can this Mas give me an explanation like I said earlier?" Pinta the man now looked more excited.
Sobri only then smiled, then nodded lightly.
"I can't really explain, sir. This is just from what I know. I give you an example. For example, this is, sir. There are people who sell a house for one hundred million rupiah if paid in cash. Then he offered to pay on credit for five years with a total payment of one hundred and fifty million rupiah. Then the buyer takes the offer and carries out the transaction with the seller. Well, then credit there the law is permissible, in the sense that it is not haram, sir." Obviously Sobri later.
The man just nodded his head.
"That does not include usury as my wife said, Mas?" Ask the man later.
Sobri slightly shook his head, "No, sir. Because the credit is in the form of an offer and the decision is taken by the buyer. In general, this form of credit is not prohibited. There is a Qabul ijab in it that validates the transaction." Sobri.
Again the man just nodded.
"Another thing that is a problem in this credit case, sir. If there are other parties or certain parties involved in the transaction process." Imbuh Sobri later.
"other side? That third party, Mas?" Ask the man again.
"Really, Sir. For example, there are people who make credit to car sales or showrooms for example. Then then this showroom turned out not to have enough money to provide various units of the car, so he took the other party, the bank. Well, the Bank here acts as a lender to the showroom. So that the purchase of a car in his showroom by way of credit is done through the bank." Sobri's law after that.
"If that's how it is, my dear?" Ask the man again.
The man then nodded his head.
"Lantas, Mommy. What would be the solution if faced with such a situation?" Asked the man as if he wanted to continue gaining understanding from Sobri.
"Look, Sir. As I said earlier, credit related to the bank is illegal. Well, if you want to keep transacting, then the solution is the transfer of transactions." Obviously Sobri again.
The man frowned and then nodded his head.
"What kind of transaction transfer and how, Mas?" Again, question after question emerged from the man.
"It means this, sir. As a buyer, the credit transaction is only with the seller in accordance with the commitment and applicable provisions. Or according to his jab. The business of the sellers who work with the banks, let it be their business, sir." Obviously Sobri later.
The man now smiled slightly as he nodded his head.
"Means to buy goods with credit is still allowed, huh Mas huh? " Task the man again to Sobri as if he still wants to find clarity.
"Allah subhanahu wata’ala justify a servant to conduct a sale and purchase transaction, sir. All forms of original buying and selling meet the guidelines that have been stated by His Majesty Shallallahu ‘alaihi wasallam and as already described by the scholars in the book of turats fiqh, is practicable. The face of buying and selling is to make a profit. Between the advantages of buying and selling cash and buying and selling credit or tempo, is the same allowed by sharia." Sobri explained again.
The man only then nodded while continuing to listen to Sobri's explanation.
"Specifically buying and selling credit, the similarity of profits obtained through buying and selling on credit is often mistakenly discourse by a group of people. Many people think that buying and selling credit is the same as nganakne money or riba. Though, Sir. It's not at all what it was meant to be. This credit buying and selling was once also done by the pagans of Jahiliyah during the prophetic treatise of His Majesty Muhammad shallallahu ‘alaihi wasallam, but it is firmly denied by Allah through Surat al-Baqarah verse 275, Alladziina ya'kuluunar-ribaa laa yaquumuuna Illa kamaa yaquumuul-ladzii yatakhoyyathuhusy-syaithoonu minal-mas. Dzaalika biannahum qooluu Innamaal-bai'u mitslur-ribaa, wa ahallallaahul-bai'a wa harromar-ribaa. Faman jaa'ahuu mau'idzotum-mir-robbihii fantahaa faahuu maa salaf. Amruhuu ilallah. Wa man 'aada faulaaika ashhaabun - naar. The hum fiihaa kholiduun. The one who eats usury cannot stand but as the one who is possessed by a demon out of madness. That is because they say that buying and selling equals usury. Allah has forbidden us to buy and sell usury. Whoever gets a warning from his Lord, then he stops, then what he has obtained first becomes his own and his business is up to Allah. Whoever repeats, then they are the inhabitants of hell, they will abide therein."Obviously Sobri later.
"So yes, my mother. So understand me now, Mas." The man nodded his head.
"That's how it is, sir. Through that verse, God also threatens that people who are similar between the benefits of buying and selling obtained on credit with the benefits obtained from usury." Sobri again.
"But indeed to distinguish it will be very difficult indeed, Mas." The man's voice too.
"Indeed, Sir. At first glance between the two, namely the practice of buying and selling and riba are almost the same, there are even similarities. But it's actually different. The main difference is in the process of the contract used and its practice. Perhaps, this is the reason why Allah SWT gives special emphasis to this buying and selling in the Qur’an, that's because most human needs must be met with the way to make buying and selling transactions and other similar ones included in it must be obtained by way of credit." Sobri Terang.
"Yes yes. Very clear now, Mom. It turns out that this Mas is really a highly insightful santri. Thank God I met up with the sampeyan, Mas." The man seemed to have really gained enlightenment this time.
Sobri just smiled.
"In the cottage is also taught a chapter like this huh, Mas?" Ask the man later.
"Almost all the problems have actually been described in the book of scholars, sir. Sometimes in one book we learn a few chapters. And it just so happens that this credit law I've studied the law of jurisprudence." Sahut Sobri while throwing his smile towards the man.
"That's it, Mas. So credit is also in science yes, Mas." The man for the umpteenth time nodded his head between admiration also understood.
"Really, Sir. Sell and buy credit in fiqih terms called bai‘ taqsiith. The buying and selling with tempo is called bai’ bi al-tsamani al-aajil. If buying and selling tempo or taqsiith accompanied by a down payment or DP, it is called bai’ urbaan. All three are buying and selling at non-cash prices or delayed prices, sir." Sobri later revealed.
"Dear' taqsiith? Emm, I have to remember this, Mas. Yes, let me give my wife an understanding." The man afterwards.
"For the explanation is the same as credit huh, Mas?" Imbuhnya.
"More or less, sir. Because in contemporary fiqh literature, bai’ taqsiith is the practice of buying and selling at a tempo price paid to the seller in the form of agreed installments. Meanwhile, the seller delivers the merchandise or bidloah he sells to the buyer immediately at the time of the purchase contract. The buyer's obligation is to submit the price for the goods purchased in the form of term installments. Well, that is why it is called by the term bai’ taqsiith is because it contains it to a form of buying and selling transactions with the characteristics of the agreed price, the same as the market price, the same as, or higher than the market price, or vice versa, lower than the market price. But the general thing happens as we know it, sir. In general the price of bai’ taqsiith goods is higher than the market selling price." Sobri once again explained.
"Imam Nawawi also stated in the book of Raudlatu al-Thalibin, that selling legal credit is permissible, sir. So you do not worry to make purchases on credit as long as it is in accordance with the syari'at which means without intermediaries and without interest. Because it will be usury if there is a ziyadah or additional, flowers. But as long as the agreement is agreed, it doesn't matter, it's allowed, sir." Sobri later said.
The man nodded his head once more.
"Thank you very much, Mom. So clear now. Just this first I met a young man as smart as sampeyan. What this means to me means so much to me who doesn't know what this is, Mas." The man really meant it.
"No need to bother, sir. I'm just doing what I can, sir." Sobri Sahut.
"Thank you again, Mom." Said the man later.
"Oh, yes, Mas. Introduce me Dibyo." Said the man while sticking out his hand.
Sobri grabbed it while introducing herself.
