Mas Duda Looking For Mom Milk
Gono - Gini Treasure of the Dead Divorce

Gono-gini property is a problem that must be faced every time a divorce occurs. Not only divorce due to incompatibility in fostering a household, but also divorce because one husband or wife died which is commonly called a dead divorce.

Now, presumably Mother Rini and Father Harja fuss about the problem of gono-gini treasures. Since the late Cellia was gone, there has never been a discussion about gono-gini treasures at all. So that it is now the right time for the two of them to ask for a treasure gono-gini on behalf of the late Cellia.

"It has been more than a year since Cellia's departure, and you have never discussed the treasure of gono-gini" Harja's father told Tama.

"That's exactly Tama. Though almost two years married to Cellia, of course there are treasures together, right?" ask Mother Rini now. After that, Mother Rini looked at Anaya and stood behind Tama. "Or not all the treasure you use to enrich your young wife," said Mother Rini.

Quickly, but still polite Tama warned her former in-laws. "Please if talking is polite. Whose young wife? Does Tama have an old wife? Need Father and Mother to know that Anaya is Tama's only wife now" Anaya replied.

Tama took a rough breath and looked at her former father-in-law, "Need Daddy and Mommy know, Tama is nothing with Anaya. The woman who marries Tama is not a woman of the lower middle class. She is the only daughter of a best neurologist in Jakarta. Then, if Tama's salary as an IT staff alone is nothing with the wealth given by his father. However, Anaya paid no attention to that at all. He married Tama in addition to his love for Tama, also because of his love for Citra."

Not just nonsense. Only, Tama needs to emphasize that Anaya is not a woman who only hardens her property. After all, however Anaya is quite capable. Financially, Anaya is very capable. However, Tama is very sure that the reason Anaya wants to be with him is first because of her love for Citra, and second only because of her love for Tama.

“Begini Tama .. Aren't you two divorced dead? Gono-gini property is also mandatory to be divided equally, because husband and wife have the same rights?” ask Daddy now.

The Marriage Law does stipulate that the division of property due to death must be done fairly. The division is not only about gono-gini treasures, but also includes inheritance. With a fair share, the property will not be a source of division in the family.

Divisions due to the problem of property left by a deceased person is certainly not desired by anyone. Either by the living, or the dead.

"The house you sold, should be divided equally dong?" Budi's father is still chasing Tama about his wedding house with the late Cellia which Tama eventually sold.

Then he looked at Father Budi, "Should Dad ask first, where does the marriage house come from? It was Tama's innate treasure. Tama's hard work so far. Innate property belongs to the person who owns it before the full wedding. Not a gono-gini treasure, Dad. Of course you also know in buying the house there is money from Mama and Papa Tama as well."

Now it's Tama's turn to explain that the house she sells is a treasure that is innate, not a gono-gini treasure.  Innate property is a type of property carried by a wife or husband before undergoing marriage. Innate property can come from various sources, for example, income when still unmarried, gifts, or inheritance.

Unlike common property, the ownership of this type of property is on the side that acquires or carries it. Therefore, this type of property is not included in the property of gono-gini that needs to be divided when divorce occurs, whether divorce is dead or divorce is alive.

According to Tama, yes the result of the sale of the house is entirely his because he owned the house before the wedding was held.

Anaya held Tama's hand there, "Just give it Mas .. Think of it as alms," Anaya said softly.

Tama could only sigh violently. "It is not so dear .. they should know which are the innate treasures and which are the gono-gini treasures. Can't ask for property that's not his right."

Tama seems still keukeh to his understanding of innate treasures and gono-gini treasures. For him, the house was his work for many years. Even after marriage, the late Cellia was also full-time at home. So, the source of income is only from Tama only.

"It's okay, just give it .. with black on white. Once again they harass Citra, do not stay silent," whispered Anaya again.

Tama looks silent. While Mama Rina and Papa Budi seemed to shake his head. They know exactly how Tama saved up and bought the house with his work. It feels as parents are also not willing if the results of Tama's hard work must be divided equally.

"Give it up .. Do I need it?" whispered Anaya again.

Tama shook her head faintly, "No need. I'm just."

Then Tama looked back at her former father-in-law, "Alright, Tama will give it equally. The house sold for 400 million rupiah. So that's part for the late Cellia 200 million. As well as all the jewels belonging to the late Cellia, Tama leave them to you. But not now. We're gonna lawyer up and legalize all this. Tama does not want, in another day there are people who come and disturb Citra. Tama who raised him, Tama who was in the fog widowed with one child. Now, when Tama wants to be happy and build Tama's new family, why do Daddy and Mommy behave like this?"

There was a faint ring from Tama's head, "Now this time there was an old man coming and asking for a treasure gono-gini over his dead daughter. Now, please get out of here. Tama will call at a later time and let the notary be the witness. If in the future, Father and Mother tease Citra again, Tama will not hesitate."

Let this time Tama give up. Not that he lost. It's just, not wanting to argue with her own former in-laws. It's just that, Tama regretted the attitude of Father Harja and Mother Rini to him.

Note:

Article 38 of the Marriage Act and Presidential Instruction Number 1 of 1991 is the legal basis used for the distribution of property for divorce. Indeed, when one partner dies, the treasure gono-gini must be divided equally. While the innate treasure belongs to the owner of the treasure completely.

Hopefully we can give a little knowledge. Basic parents Cellia demands there is indeed a legal basis and ask for equal division. Though the house that Tama bought was an innate treasure, not a gono-gini.
